Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Reflection period: the period during which the consumer may exercise the right of withdrawal.

Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.

Day: calendar day.

Extended duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

Durable medium: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the reflection period.

Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.

Distance contract: a contract concluded within an organized system for distance selling, whereby exclusive use is made of one or more means of distance communication until the conclusion of the contract.

Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place.

General Terms and Conditions: the present terms and conditions of the entrepreneur.

 

Article 2 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the conclusion of a distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate how the terms can be consulted and that they will be sent free of charge upon request.

If the contract is concluded electronically, the terms may be made available electronically in such a way that the consumer can easily store them on a durable medium.

If any provision of these terms is void or annulled, the remaining provisions remain fully in force.

Situations not covered by these terms shall be interpreted in accordance with their spirit and purpose.

 

Article 3 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services. Obvious errors or mistakes do not bind the entrepreneur.

Images are a truthful representation of the products; however, exact color display cannot be guaranteed.

Each offer clearly states:


  • The price (excluding import duties and VAT, where applicable)

  • Shipping costs

  • The method of payment, delivery and execution

  • Whether the right of withdrawal applies

  • The duration of the offer

  • Any additional communication costs

 

Article 4 – The Contract

The contract is concluded at the moment the consumer accepts the offer and meets the associated conditions.

If the consumer accepts electronically, the entrepreneur confirms receipt without delay.

The entrepreneur may verify whether the consumer can meet payment obligations and may refuse an order if justified.

Each contract is concluded subject to availability of products.

 

Article 5 – Right of Withdrawal

The consumer may withdraw from the contract within 14 days of receiving the product, without providing a reason.

During the reflection period, the consumer must handle the product and packaging with care.

The withdrawal must be communicated within 14 days. The product must then be returned within 14 days thereafter.

Failure to comply with these deadlines results in expiration of the right of withdrawal.

 

Article 6 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

Amounts paid will be refunded within 14 days after receipt of the returned product or proof of return shipment.

 

Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:


  • Custom-made or personalized products

  • Sealed hygienic goods if unsealed

  • Audio/video/software products if the seal is broken

  • Perishable goods

  • Products subject to market fluctuations

And certain services where performance has begun with consumer consent.

 

Article 8 – Pricing

Prices will not increase during the validity period unless due to legal VAT changes.

Obvious typographical errors do not bind the entrepreneur.

If delivery occurs outside the EU, VAT and import duties may be charged by the carrier.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that products conform to the contract and applicable legal requirements.

Defects must be reported within 14 days of delivery.

The warranty corresponds to the manufacturer’s warranty.

The warranty does not apply if:


  • The product has been modified or repaired by the consumer

  • The product has been misused

  • Damage results from government regulations

 

Article 11 – Delivery and Execution

Orders are delivered within 30 days unless otherwise agreed.

If delivery is delayed, the consumer may cancel the contract free of charge.

Risk transfers to the consumer upon delivery.

 

Article 12 – Extended Duration Transactions

Indefinite contracts may be terminated with a maximum one-month notice period.

Fixed-term contracts may be terminated at the end of the term with a maximum one-month notice.

 

Article 13 – Payment

Payments must be made within 7 business days.

Incorrect payment details must be reported immediately.

 

Article 14 – Complaints

Complaints must be submitted within 7 days after discovery.

They will be handled within 14 days.

 

Article 15 – Disputes

Dutch law applies exclusively.

 

Article 16 – CESOP

In accordance with EU regulations effective from 2024 regarding VAT legislation and the Central Electronic System of Payment Information (CESOP), payment service providers may register transaction data in the European CESOP system.
